1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and IRON ADS LLC ("Company," "we," "us," or "our") concerning your access to and use of the Hypotize platform (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the Service under applicable law
• Provide accurate and complete registration information

By using the Service, you represent and warrant that you meet these requirements.

3. Account Registration and Security

3.1 Account Creation

4. Subscription Plans and Billing

4.1 Subscription Tiers

We offer various subscription plans:

• Paid Plans: Solo and Team tiers with varying features and pricing

4.2 Payment Terms

By subscribing to a paid plan, you agree to:

• Pay all fees associated with your chosen plan
• Provide valid payment information
• Authorize us to charge your payment method on a recurring basis
• Pay all applicable taxes

4.3 Billing Cycle

Subscriptions are billed in advance on a monthly or annual basis, depending on your chosen plan. Your subscription will automatically renew unless you cancel before the renewal date.

4.4 Price Changes

We reserve the right to modify our pricing. We will provide you with at least 30 days' notice before any price increase takes effect. Your continued use of the Service after the price change constitutes acceptance of the new price.

5. Refund and Cancellation Policy

5.1 Refund Eligibility

You may request a full refund within 14 days of your initial purchase or renewal if:

• You are not satisfied with the Service
• The Service does not meet your expectations
• You experience technical issues that prevent you from using the Service

5.2 Refund Process

To request a refund:

2. Provide your account information and reason for refund
3. We will process your refund within 5-10 business days

5.3 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will continue to have access to paid features until the end of your current billing period. No refunds are provided for partial months or unused features.

6. Acceptable Use

6.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree to:

• Use the Service for managing growth experiments and related activities
• Comply with all applicable laws and regulations
• Respect the intellectual property rights of others
• Maintain the confidentiality of your account credentials

6.2 Prohibited Activities

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service or other accounts
• Interfere with or disrupt the Service or servers
• Use the Service to spam or send unsolicited communications
• Scrape, copy, or reverse engineer the Service
• Resell or redistribute the Service without authorization

7. User Content and Data

You retain all ownership rights to the content you create, upload, or store in the Service ("User Content"). This includes experiments, ideas, hypotheses, results, and any other data you input.

7.2 License to Use

By submitting User Content, you grant us a limited, non-exclusive, royalty-free license to:

• Store, process, and display your content to provide the Service
• Create backups for data protection
• Analyze usage patterns to improve the Service (anonymized)

7.3 Content Responsibility

You are solely responsible for your User Content and the consequences of posting or publishing it. We do not endorse or guarantee the accuracy of any User Content.

8. Intellectual Property Rights

8.1 Our Proprietary Rights

The Service and its original content, features, and functionality are owned by IRON ADS LLC and are protected by:

• Copyright, trademark, and patent laws
• International treaties and conventions
• Other proprietary rights laws

8.2 Trademarks

"Hypotize" and related logos are trademarks of IRON ADS LLC. You may not use these trademarks without our prior written consent.

8.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use and incorporate them without any obligation to you.

9. Third-Party MCP Clients

The Service may be accessed through third-party MCP clients such as Claude and Codex. Your use of these clients is subject to:

• The third party's own terms and conditions
• The third party's privacy policies
• Any applicable API usage limits

We are not responsible for the availability, accuracy, or reliability of third-party MCP clients.

10. Disclaimers and Limitations

10.1 Service Availability

We strive to provide continuous access to the Service but do not guarantee uninterrupted or error-free operation. We may suspend or terminate the Service for maintenance, updates, or other reasons.

10.2 "AS IS" Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including but not limited to:

• Merchantability and fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content
• Compatibility with your systems

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IRON ADS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless IRON ADS LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

12.3 Jurisdiction

Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of such courts.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

14.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• Your payment method fails
• You engage in fraudulent or illegal activity
• We are required to do so by law

14.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your User Content after a reasonable grace period, except where required to retain it by law.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and IRON ADS LLC regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
